Three More States to Throw the Switch on Comprehensive Privacy Rules in 2026.

As Congress continues to tarry on comprehensive privacy legislation, three states will ring in the new year with their own consumer data privacy rules. Kentucky, Indiana and Rhode Island will join 16 other states with comprehensive consumer privacy laws in force. Other states have enacted more limited protections.

The Kentucky Consumer Data Privacy Act (KCDPA), and Indiana Consumer Data Protection Act (ICDPA) are modeled on laws in California and elsewhere in that they apply to businesses operating in their respective states that process data from at least 100,000 residents annually, or 25,000 residents if the business derives half or more of its revenue from the sale of personal information.

Indiana Releases Consumer Data Privacy Bill of Rights

Ahead of implementation of Indiana's comprehensive data privacy law, Indiana’s Attorney General has released a Consumer Data Privacy Bill of Rights describing how the Indiana Consumer Data Protection Act ("ICDPA"), enacted in 2023, will operate when it takes effect on January 1, 2026. Although styled for consumers, the Bill of Rights functions as a practical compliance roadmap for businesses subject to the law. It reiterates the ICDPA’s scope and thresholds, articulates the core consumer rights, and underscores concrete controller obligations around transparency, data minimization, purpose limitation, sensitive data handling, and response timelines.

Indiana bill would expand background checks for day care employees

INDIANAPOLIS (WISH) — An Indiana lawmaker wants to close a loophole involving background checks at Indiana day care facilities for children.

News 8 talked to parents who say they were shocked to hear that the proposal was not already a requirement.

There are a lot of day care facilities that require criminal background checks for all of their employees, but the state law only requires that some people get those criminal background checks.
