Utah scales back reach of generative AI consumer protection law

The Utah legislature amended its Artificial Intelligence Policy Act to focus on “high-risk” generative AI interactions and to establish a new safe harbor.

Background

In March 2024, Utah became the first state to enact legislation specifically targeting generative AI (Gen AI).  The Utah Artificial Intelligence Policy Act (UAIPA), which took effect on May 1, 2024, imposed certain disclosure obligations on entities using Gen AI tools to interact with their customers and confirmed that those entities cannot avoid liability under Utah consumer protection law because the violative statement or act derived from Gen AI.  The UAIPA also sought to encourage AI innovation by establishing the Office of Artificial Intelligence Policy to administer an AI Learning Laboratory Program, consult with businesses and other stakeholders about potential regulatory proposals, and grant temporary “regulatory mitigations” to entities developing AI systems.

Bill proposes changes to Utah’s sex offender registry

SALT LAKE CITY — A controversial bill proposing changes to Utah’s sex offender registry was met with both support and criticism on Capitol Hill Friday.

When SB155 was first released by Senator Todd Weiler last week it was met with harsh criticism, on Friday a substitute bill was presented in the Senate Judiciary, Law Enforcement, and Criminal Justice Committee. The original version of SB155 focused on moving certain criminal offenses with a lifetime sex offender registration to the list of offenses only requiring a 10-year registration.

Utah Becomes First State To Enact AI-Centric Consumer Protection Law

On March 13, 2024, Utah enacted the Utah Artificial Intelligence Policy Act (UAIP), which imposes certain disclosure requirements on entities using generative AI tools with their customers, and limits an entity’s ability to “blame” generative AI for statements or acts that constitute consumer protection violations.

Companies subject to the UAIP will need to ensure they have the appropriate disclosure regime in place, and other companies should consider whether the UAIP approach is a good business practice they should adopt. The UAIP goes into effect on May 1, 2024.
